Окремі питання імплементації законодавства Європейського союзу в земельне законодавство України

Abstract

Проаналізовано окремі питання імплементації законодавства Європейського Союзу в земельне законодавство України. Обґрунтовано, що поглиблення співробітництва з Європейським Союзом є дуже важливим елементом зміцнення стабільності та безпеки на Європейському континенті, стимулюватиме проведення внутрішніх економічних та політичних реформ, сприятиме суспільному прогресу та розбудові соціально орієнтованої економіки України. Розглянуто адаптацію законодавства України до законодавства ЄС та встановлено, що вона є головною складовою процесу інтеграції України до Європейського Союзу, що, своєю чергою, є пріоритетним напрямом української зовнішньої політики. In this article, some issues of the implementation of the European Union legislation in the land legislation of Ukraine are formalized. It is substantiated that deepening of cooperation with the European Union is a very important element of strengthening stability and security on the European continent, will stimulate domestic economic and political reforms, promote social progress and build a socially oriented economy of Ukraine. It is considered that adaptation of the Ukrainian legislation to the EU legislation is a priority component of the process of Ukraine’s integration into the European Union, which in turn is a priority direction of Ukrainian foreign policy. This problem is relevant, primarily because one of the ways to prevent legal defects in land legal regulation in Ukraine now and in the future is to ensure the implementation of the legislation of the European Union (hereinafter – the EU) in the national land legislation in accordance with the requirements. Realization of the course on the European integration of Ukraine is an integral part of the internal reforms aimed at the formation of a civil society, economic growth, raising the standard of living of the people, developing democracy, ensuring the guarantees of the rule of law, freedom of speech, protection of human rights and freedoms, strengthening of national security. and legality. In the land legal science of Ukraine, certain legal aspects of the implementation of EU legislation in the land legislation of Ukraine were studied by such academic lawyers as: V.I. Andrievtsev, S.V. Yelkin, P. F. Kulinich, N. R. Malysheva, V. V. Nosik, DV Sannikov, T. B. Sarkisova, V. I. Semchik, E. O. Pidlisny, Yu. S. Shemshuchenko, M. V. Shulga, D. Yatsenko, other scientists. At the same time, the signing and ratification by the Ukrainian Parliament in 2014 of the Association Agreement between Ukraine, on the one hand, and the European Union, the European Atomic Energy Community and their member states, on the other hand, and the need for the implementation of national legislation to the requirements of the EU in parts of the legal regulation of the use and protection of land as the main national wealth determine the relevance of the chosen topic of research
