Диференціація кримінальної відповідальності за злочинні посягання у сфері економіки: автореферат

Abstract

Дисертацію присвячено дослідженню проблем диференціації кримінальної відповідальності за злочинні посягання у сфері економіки. Розглянуто підходи науковців до визначення понять «злочинне посягання у сфері економіки» та «диференціація кримінальної відповідальності». Визначено істотні ознаки цих понять, виокремлено ряд засобів диференціації кримінальної відповідальності за злочинні посягання у сфері економіки. Виокремлено вимоги, яким повинні відповідати засоби диференціації. Проаналізовано можливості використання засобів диференціації щодо злочинних посягань у сфері економіки. Сформульовано конкретні пропозиції щодо поглиблення диференціації кримінальної відповідальності за злочинні посягання у сфері економіки, зокрема визначено перспективи запровадження кримінального проступку, вдосконалення системи кваліфікуючих та особливо кваліфікуючих ознак, а також удосконалення видів, розмірів і строків покарань за злочинні посягання у сфері економіки тощо. The thesis is devoted to the study of problems of differentiation criminal liability for criminal trespass in the economy. The approaches of scientists to define the terms «criminal trespass in the economy» and «differentiation criminal liability». Based on the analysis of criminal literature revealed that no single approach to the definition of criminal trespass in the economy and thus separation range attacks should be considered committed in the economic sphere. Also highlighted the essential features differentiating criminal liability and therefore the definition of the concept as a process of the legislature, which resulted in the criminal law set different amounts of criminal responsibility, depending on the means of differentiation. Found that differentiation means of criminal responsibility should be considered the circumstances provided for in the current Criminal Code and for which the legislator has determined the direction and strength of their impact on the volume of criminal responsibility. Given this stated requirements to be met by means of differentiation of criminal responsibility and analyzed the possibility of using these means differentiation with respect to criminal attacks in the economy. As a result, formulated concrete proposals for increasing differentiation criminal liability for criminal trespass in the economy, including defined perspective of a criminal offense, to improve qualifying and especially aggravating circumstances, and improving the types, sizes and terms of penalties for criminal trespass in the economy and so on.
