Особливості провадження нотаріальної діяльності на українських землях під час Другої світової війни

Abstract

Проаналізовано актуальні питання правового регулювання нотаріальної діяльності під час Другої світової війни. Розглянуто діяльність органів нотаріату на українських землях у складі Союзу Радянських Соціалістичних Республік. Охарактеризовано Постанову Ради Народних Комісарів УРСР від 3 грудня 1940 р. № 1615 «Про зміну і доповнення Нотаріального положення УРСР». Констатовано, що перед початком Другої світової війни правове регулювання діяльності органів нотаріату Української СРР здійснювалося двома основними нормативними актами: Положенням про судоустрій УСРР та Нотаріальною Уставою, які діяли до 1944 року. Проаналізовано також Постанову Ради Народних Комісарів УРСР від 9 серпня 1944 р. № 1016 «Про затвердження Положення про Державний нотаріат УРСР і Переліку документів, на підставі яких учиняються нотаріальні виконавчі написи на стягнення грошей та майна», яка регулювала нотаріальну діяльність на українських землях до завершення Другої світової війни. Зазначено, що більшість норм указаного Положення є актуальними. The article deals with the issues of the legal regulation of the notarial activities during World War II. The questions of the activities of notaries public on the Ukrainian lands as a part of the Union of Soviet Socialist Republics are considered. The author characterizes the decree of the Council of People’s Commissars of the Ukrainian SSR «On change and supplement of the Notarial regulations of the Ukrainian SSR» № 1615 from December 3, 1940. According to the scientist, at the beginning of the Second World War, the legal regulation of the activities of the notaries public of the Ukrainian SSR was carried out with two major normative acts: the Regulations on the judiciary of the Ukrainian SSR and the Notarial regulations, which functioned to 1944. The analysis of the normative act of the Ukrainian SSR – the Regulations on the State notary system of the Ukrainian SSR, approved by the Council of People’s Commissars of the Ukrainian SSR from 9 September 1944, № 1016 was made. The author examines the procedure for the access to the notary profession, including the requirements of educational qualification and experience of practical activity. In particular, persons who had higher or secondary legal education, as well as persons who had at least 2 years of experience as a judge, prosecutor, investigator, legal adviser, or not less than 2 years of experience of notarial work could be a notary public. That is positive that the regulations provided for limitable access to the notary public. So persons deprived of the vote, or persons who had a criminal record could not be a notary public. Candidates for the position of a notary public or deputy notary public had to pass a special exam. Notaries public could not combine other posts, except for the elective posts and teaching work. According to the author, most norms of the Regulations on the State notary system of the Ukrainian SSR remain relevant nowadays.
