Деякі проблемні питання законодавчого забезпечення діяльності поліцейських з виявлення правопорушень у громадських місцях

Abstract

Опрацьовано нормативно-правову базу, що регламентує діяльність по-ліцейських з виявлення правопорушень у громадських місцях. Визначено, що насамперед потрібно: уніфікувати поняття «громадське місце», класифікувати їх, удосконалити законодавство у частині окреслення правових меж дій поліцейських під час виявлення правопорушень у громадських місцях, упровадити технічні засоби спостереження. The fulfillment of the tasks facing the National Police of Ukraine covers the realization of the principles, established by the universal values, respect to human rights and freedoms, recognition of their priority in relations with the state. Changes in social economical and political situation in the state predetermine the necessity of the formation of the new approaches for solving the problems in the law enforcement sphere, that can’t be fulfilled without detailed legal regulation. That is why our aim is to determine the ways of the optimization of the police activity concerning detecting crimes in public places and guarantee of rights and freedoms of the citizens in this sphere. One of the main tasks of the units, providing the public order safety is active fight with any crimes committed in public places. The notion «public place» is fixed in the Law of Ukraine «On Prevention and Control of Tobacco Harms on the Health of the Citizen of Ukraine» from 22.09.2005. The majority of legislative and normative acts don’t define such notion, just give the list of such places. According to the legislature the data of the criminal offences, committed in public places are recorded in the Register. The criminal offences, committed for a long period of time and criminal offences, committed in living quarters can’t be considered as criminal offences committed in public places. From the total number of criminal offences, committed in public places street offences are stand out. Detecting offences, committed in public places, police officers applying the normative-legal database and technical means and equipments. Therefore, for the effective fulfillment of the task, the notion «public place» should be unified and public places clearly and firmly classified and fixed in the legislature of Ukraine, as well as continuously improve the normative-legal database, that defined the legal possibilities of the police officers while detecting offences, strengthen the guarantee of the rights of citizens in the sphere of public order through the improvement of organizational structure of the police and cooperation of its bodies; improvement of professional qualification of police workers; their technical, material and psychological implementation.
