Адміністративна відповідальність за порушення законодавства про екологічну експертизу

Abstract

Розглянуто поняття та види екологічних правопорушень як підстав юридичної відповідальності. Проаналізовано зміст адміністративної відповідальності за екологічні правопорушення. Доведено доцільність виокремлення правової відповідальності у сфері екологічної експертизи. Досліджено інститут адміністративної відповідальності за правопорушення у сфері екологічної експертизи як складову забезпечення реалізації державної екологічної політики поряд із адміністративним забезпеченням охорони навколишнього природного середовища. The article deals with the concept and types of environmental violations as the basis for legal liability. The author analyzes the content of administrative responsibility for environmental offences, as well considers the issue of separation of legal liability in the field of environmental examination. The institution of administrative responsibility for offences of environmental examination is investigated as a part of ensuring implementation of state environmental policy, including administrative provision of environmental protection. Environmental impact assessment, as a functional means for environmental protection mechanism, ensures the possibility of exercising rights of citizens to a favorable environment in the form of preventing negative impacts of economic activity on the environment. Assessment of the impact of the future activity object on the environment is established at the planning stage, it prevents the negative social, economic and other implications of implementation of the object of environmental examination, and it is important for business entity too. Environmental examination is the guarantor of fulfillment of environmental and legal norms, regulations; it has a preventive nature, as it is carried out before the beginning of economic activity. The essence of the administrative responsibility for violation of the legislation on environmental examination is a set of administrative illegal acts encroaching on ecological safety in the field of environmental impact assessment. State enforcement of environmental requirements is realized through the application of administrative responsibility in the field of environmental impact assessment. Administrative responsibility in the field of environmental impact assessment has such functions as: stimulating; preventive; compensatory; punitive. It is advisable to make additions to the legislation on violations in the field of environmental examination listed in the law «On environmental impact assessment».
