Нотаріальні правочини в господарській діяльності аграрних суб’єктів України

Abstract

Присвячено актуальним питанням правового регулювання здійснення нотаріальних проваджень за участю аграрних суб’єктів в Україні. Розглянуто питання про нотаріальне посвідчення правочинів від імені аграрних товаровиробників. Наголошено, що повноваження нотаріальних органів щодо участі аграрних суб’єктів у нотаріальному процесі впродовж 2015–2016 років зазнали суттєвих змін, зокрема в частині розширення повноважень нотаріальних органів – стосовно і самого нотаріального провадження, і вчинення інших, не нотаріальних, дій, які, як і нотаріальні, здійснюються з метою надання їм юридичної вірогідності. The article deals with the topical issues of legal regulation of the exercise of notarial proceedings involving agricultural subjects in Ukraine. The issues of notarial certification of transactions on behalf of agrarian commodity producers are considered. The author proves that the authority of notarial bodies concerning the participation of agrarian subjects in the notary process for 2015-2016 underwent significant changes, particularly in expanding powers of notarial bodies both for notary proceedings and committing other un-notarial actions; these actions and other notarial acts are carried out with the aim of providing them with a legal possibility. A notarial certification can be made to such a transaction that meets the general requirements established by legislation, namely the content of the transaction may not contradict the Civil Code and other acts of civil legislation, as well as moral principles of the society. Signing and certificating the transaction in notarial order, the notary acts as a guarantor on behalf of the state, the agrarian entity as an acquirer of the property is protected from all kinds of surprises, and the agreement is lawful and sustainable. The author points out that the activities of the notarial bodies concern to the most important property issues in the activities of agrarian subjects. The notary with the participation of agrarian commodity producers carries out notarial actions (transactions and other acts), and other statutory powers, in particular the state registration of agrarian subjects and their termination.
