Теоретико-правові аспекти протидії адміністративним правопорушенням на залізничному транспорті

Abstract

Розглянуто теоретичні аспекти протидії адміністративним правопорушенням на залізничному транспорті. Досліджено методологію, структуру рівнів протидії та теоретичні підходи осмислення поняття протидії правопорушенням органами залізничного транспорту. Окреслено механізми протидії адміністративним правопорушенням на залізничному транспорті. Акцентовано на комплексному уявленні про сутність і призначення протидії адміністративним правопорушенням як елемента суспільного управління. The article deals with the theoretical aspects of counteraction to administrative offences on railway transport. The methodology, the structure of countermeasures levels and theoretical approaches to understanding the concept of countermeasures by bodies of railway transport are investigated. The mechanism of counteraction to administrative offences on railway transport is outlined. A special attention is paid to the comprehensive understanding of the essence and purpose of the counteraction to administrative offences as an element of social control. Theoretical researches of the counteraction to administrative offences at the level of system development of organizational and management principles of the activities concerning the prevention of certain types or groups of offences by various state institutions, as well as taking measures of impact on the causes and conditions of offences to neutralize them traditionally make up the range of interests of Criminology. The counteraction to administrative offences on railway transport is not limited by organizational and functional principles of the relevant activity; it is a complicated formation, which consists of changing units of direct and indirect relationships between elements in the system based on the integration of the various levels of influence on criminogenic factors. Their differentiation causes the necessity to divide levels of counteraction with regard to fixed and some new approaches. The specific content and the forms of the exercise of countermeasures can be considered from the theoretical and methodological points of legal branches. Studying organizational-legal forms of state bodies we can regard the counteraction to administrative offences as a system feature of law-enforcement agencies. The activities of all participants of public relations aimed at search and involvement of means of legal regulation may have remedial and law-enforcement character.
