Вдосконалення порядку тимчасового обмеження права боржника на виїзд за межі України

Abstract

Досліджено особливості порядку тимчасового обмеження права боржника на виїзд за межі України. Виокремлено проблеми правового регулювання цього інституту цивільного процесу. Запропоновано негайно виконувати ухвалу суду про встановлення тимчасового обмеження боржника у праві виїзду за межі України, зобов’язати суд негайно інформувати боржника про обмеження його права на виїзд за кордон, а також нову редакцію статті 377-1 Цивільного процесуального кодексу України. The article deals with the peculiarities of the procedure for the temporary restriction of the right of the debtor to travel outside the national boundaries. The problems of legal regulation of this institution of civil procedure are distinguished. A court decision establishing the temporary restriction of the right of the debtor to travel outside Ukraine is proposed to carry out immediately. A new wording of Article 377-1 of the Civil Procedural Code ofUkraine is suggested: «1. The issue of the temporary restriction of the debtor – a natural person or a head of the debtor – a legal entity on the right to travel outside the national boundaries while executing judgments and decisions of other bodies (officials) is decided by the court at the location of a state executive service under the submission of a state executor, agreed with the head of the state executive service. 2. The Court considers immediately a filing referred to the first paragraph of this article without the call or the notification of the parties and other interested persons with the assistance of a state executor. 3. The court decision establishing a temporary limitation of the debtor – a natural person or a head of the debtor – a legal entity on the right to travel outside Ukraine is executed immediately in the manner prescribed for the execution of judicial decisions. 4. A copy of the decision is sent to the person against whom a temporary restriction of the right to travel outside Ukraine is applied. It is sent immediately after delivery of a judgment. 5. An appeal against the restriction of the right to travel outside the national boundaries does not stop its implementation and does not preclude the further proceedings. 6. A Temporary restriction of the debtor – a natural person or a head of the debtor – a legal entity on the right to travel outside the national boundaries may be canceled by the court that ruled such a restriction.
