Проблеми та напрями вдосконалення законодавства в Україні у сфері професійного навчання зареєстрованих безробітних

Abstract

Досліджено особливості професійного навчання зареєстрованих безробітних. Визначено умови та порядок проходження професійного навчання. Розглянуто особливості складного договірного юридичного оформлення організації надання цієї соціальної послуги на основі дослідження суттєвих умов угод, які опосередковують відносини у цій сфері. Проаналізовано положення чинного законодавства України, зарубіжних країн, матеріали судової практики та наведено пропозиції щодо удосконалення правового регулювання організації професійного навчання зареєстрованих безробітних. The article deals with the features of the vocational training of the registered unemployed as a free service, which is financed at the expense of Social Insurance Fund of Ukraine in case of unemployment. The conditions and the procedure of the vocational training are determined. It is proved that the conditions of the vocational training for citizens in Ukraine are not clearly identified, with the exception of the acquisition of the status of the unemployed person. In addition to that, a list of institutions that can provide vocational training is still limited, so you need to predict a preferential right to receive this type of social service for particular categories of citizens. The features of the comprehensive contractual legal registration of the vocational training organization based on the research of the essential terms of the agreements that mediate relationships in this field are considered. It is substantiated that the successful completion of the vocational training on the instruction of the employer should ensure the employment of the unemployed for a period of at least 12 months. In this case, a territorial body of the State Employment Service, the organization that will carry out the training, an employer and the unemployed conclude the agreement on vocational training on the instruction of an employer. The agreement must provide the following essential conditions: rights and duties of its parties, terms of payment, conditions of anticipated dissolution, and sources of financing of vocational training. It is concluded that the referral for the vocational training can be considered as the result of a mutual agreement of conditions of vocational training based on the arbitrary application of unemployed persons with a request to send them to vocational training for a particular profession. The jobless would familiarize with the referral against receipt. The provisions of the current legislation of Ukraine and foreign countries, the records of the court practice are analyzed. The suggestions of improving the legal regulation in the field of vocational training of the registered unemployed are made.
