Правоохоронні органи як суб'єкти адміністративно-договірної компетенції

Abstract

Досліджено особливості правоохоронного органу як сторони адміністративного договору та як учасника адміністративних правовідносин. Здійснено характеристику адміністративно-правового статусу правоохоронних органів як суб’єктів адміністративно-договірної компетенції. Проаналізовано норми та положення нормативно-правових актів України, котрі визначають систему правоохоронних органів України, а також статус окремих правоохоронних органів. The features of the law enforcement body as a party of administrative contract and as a party of the administrative relationships are studied. Characteristics of administrative – legal status of the law enforcement as subjects of the administrative – contracting authority is accomplished. The rules and provisions of legal acts of Ukraine, which define a system of the national law enforcement and the status of individual law enforcement bodies are analyzed. In the article it is pointed out that the law enforcement body as a party of administrative contract and a party of administrative relationships is characterized by administrative – legal status, part of which is administrative capacity. Such capacity is determined by legal norms and depends on the execution of the law enforcement functions by specific public authorities. Therefore, it is important to study law, defining the concept, features and types of the law enforcement and their administrative – legal status. Despite the large number of scientific researches, where the law enforcement were analyzed, their concept, nature and characteristics are still defined in different ways, sometimes with opposing positions. This state of scientific research due, above all, the lack of a clear definition of «the law enforcement (body and system) of Ukraine», which in turn necessitates reform of the law enforcement, determination their exhaustive list and general characteristics in legal acts. Today, in fact, administrative – contractual capacity of the law enforcement at the level of legislative acts is not foreseen. Typically, these joint powers are envisaged by subordinate regulatory acts. This situation does not contribute to propagation of administrative – contractual regulation in the law enforcement. Even if such authority is foreseen there is a question of the possibilities (capabilities) that are understood by these, and the procedure of their execution. This leads to maturity of initiative and independence in the law enforcement. Therefore, amendments to the competence regulations or adoption of a separate legislative act, which will determine the competence of the law enforcement bodies to use administrative contracts in their activities, are proposed.
