Інтегрована дозвільна система як складова угоди про асоціацію між Україною та ЄС

Abstract

У контексті євроінтеграційних процесів в Україні представлено оцінку сучасного стану екологічного законодавства та основні напрями адаптації до Директиви ЄС «Про промислові викиди (про інтегроване запобігання забрудненню та контроль)». Зроблено висновок, що запровадження інтегрованої екологічної дозвільної системи на основі принципу використання найкращих наявних технологій надасть змогу зменшити адміністративне навантаження на суб՚єктів господарської діяльності та покращити екологічну ситуацію в Україні. Within the framework of the Association Agreement with the European Union, Ukraine has a number of commitments to bring its legislation into line with the European law. One of the most difficult directives to implement in both institutional and value terms is Directive 2010/75/EU on industrial emissions (integrated pollution prevention and control), covering basic industry sectors, which systematically affect the environmental quality – air, water, soil and form significant amounts of waste. The provisions of the Directive on industrial emissions focus on the licensing system and procedures, as well as determining the overall structure of the integrated pollution prevention and its control. The goal of an integrated approach to pollution control is to prevent emissions and discharges to water and soil. The important line of Directive about industrial extras is also position that all permissions must be based on conclusion about the best modern technologies. The analysis of the national legislation reveals its low level of compliance with Directive 2010/75/EU. Thus, Ukraine is facing a significant amount of problems as due to imperfection of the legal framework, and considering the necessity for reformation of permissive organs. The conclusion about the establishing of the integrated ecological permissive system on the basis of principle of the use of the best modern technologies will allow decreasing the administrative loading on the subjects of economic activity and improving an ecological situation in Ukraine. The acceptance of the Ecological code that must fix fundamental principles of ecological management embracing all objects of natural environment and activity of corresponding subjects will become basis for the establishing of the integrated ecological permission.
