Щодо можливості автоматичного набуття активними оперативно-розшуковими заходами статусу негласних слідчих (розшукових) дій у межах кримінального провадження

Abstract

Розглянуто співвідношення мети, завдань та змісту доказування в кримінальному процесі й оперативного документування в межах оперативної розробки. Проаналізовано нормативні положення та наукові позиції, які доводять тотожність змісту негласних слідчих розшукових дій із оперативно-розшуковими (технічними) заходами. Обґрунтовано можливість застосування за аналогією закону дії норм Кримінального процесуального кодексу України в частині урегулювання негласних слідчих (розшукових) дій на положення Закону України «Про оперативно-розшукову діяльність» в частині проведення оперативно-розшукових заходів та використання здобутих результатів. Запропоновано положення щодо автоматичного набуття активними оперативно-розшуковими заходами статусу негласних слідчих (розшукових) дій у межах кримінального провадження з метою повного, швидкого, всебічного та об’єктивного досудового розслідування злочину (кримінального правопорушення). The relationship of goals, objectives and content of proof in a criminal procedure and operational documentation within operational development is reviewed. The regulations and scientific positions, which prove the identity of the content of the search action of covert investigators with the operational search (technical) measures are analyzed. The possibility of application by analogy of the law influence of the Criminal Procedure Code of Ukraine regarding the settlement of covert investigative (detective) on the provisions of the Law of Ukraine «On operativesearch activity» in the part of operational and search measures and the use of the obtained results are justified. Provisions for automatic acquisition by active operational search operations of covert investigative (detective) action status within criminal proceedings for the full, quick, thorough and detail pre-trial investigation of the crime (criminal offense) are proposed. The proposed provision simplifies the process of legalization of the material of operational activities, provides the process of a complete, detailed detection, termination of criminal offenses and objective implementation of the pre-trial investigation within the criminal proceedings, causes the increase of the work efficiency as of operating units of the Internal Affairs bodies and the pre-trial investigation bodies as well. The introduction of this rule provides for a significant reduction of operational-investigative load on investigators caused by the organization of covert investigative (detective) action, reduction of deadlines and saving of material resources related to the peculiarities of organization and tactics special equipment use at covert investigative (detective) action, minimizing the probability of information leakage regarding defendants and suspects of crimes and criminal offenses and ongoing or planned against them search operations or proceedings under the Criminal Procedure Code of Ukraine, which under today’s conditions is equally important.
