Місцеві референдуми в Україні

Abstract

Досліджено правову природу забезпечення права на проведення і участь у місцевих референдумах в Україні, закріпленого в Конституції України. Проаналізовано поняття референдуму та право громадян на виявлення однієї з форм безпосередньої демократії – місцевого референдуму. Запропоновано розробку нового законопроекту «Про місцеві референдуми в Україні» з урахуванням і норм чинного законодавства, і недоліків попереднього законопроекту № 7082 від 03.09.2010 р., який пройшов лише перше читання у парламенті. The legal nature of the right to hold and participate in local referendums in Ukraine, enshrined in the Constitution of Ukraine is examined in the article. The article deals with the concepts of referendum and citizens right to identify a form of direct democracy – a local referendum. It is proposed to develop a new draft law «Local referendums in Ukraine» with the current legislation as well as all the shortcomings of the previous bill number 7082 from 03.09.2010 which has passed only the first reading in Parliament. Development of a new law project «Local referendums in Ukraine» will enable local communities for solve local issues will realise their right the way of direct democratic based on European principles of Ukraine in the world community. The process of developing the law project «On local referendum in Ukraine» is complex, lengthy and requires maximum consideration of the provisions of the existing Law «On All-Ukrainian referendum», and other applicable laws of Ukraine, such as: «On Central Election Commission», «On election of Deputies of the Autonomous Republic of Crimea, local councils and village, town and city burgomaster’s», «On Local Government» and others. Six chapters that will unite 43 articles are proposed to be included in this law project. Create of a new law project will improve the mechanism of ensuring implementation of Ukraine this form of direct democracy as a local referendum, provide adequate opportunities for the implementation of decisions of local importance, and will facilitate the development of democratic society in Ukraine. In addition, the implementation of the draft law will positively affect the development of administrative units, in particular, to increase social activity of each resident, attracting people to self-process, and thus becoming a full-fledged local government in the administrative-territorial units.
