Юридичний аналіз спеціальної конфіскації майна як іншого заходу кримінально-правового характеру за КК України

Abstract

Висвітлено питання кримінально-правової характеристики спеціальної конфіскації майна як іншого заходу кримінально-правового характеру, проаналізовано кримінальне законодавство України, що регламентує спеціальну конфіскацію майна, визначено порядок призначення та застосування спеціальної конфіскації майна як іншого заходу кримінально-правового характеру за КК України, здійснено спробу охарактеризувати спеціальну конфіскацію майна як захід кримінально-правового характеру за чинним кримінальним законодавством України. The article highlights the issue of criminal law special asset forfeiture characteristics as other measures of criminal law, the analysis of criminal legislation of Ukraine regulating special confiscation of property, determined by the order of appointment and the use of special confiscation of property as another measure criminal law by the Criminal Code of Ukraine attempt to describe the special con fiscation as a measure criminal law under the current criminal legislation of Ukraine. Responding to commit criminal offenses carried out by administration of the CC of Ukraine criminal means. These are divided into two types: criminal liability in its various forms and other means of criminal law response that is not criminal liability. Art. 96-1 and 96-2, which refers to special confiscation legislator clarified the position regarding the legal nature of the special confiscation. He acknowledged its criminal legal action that is outside criminal liability and this is probably true except for the name of this form of criminal law response. The purpose of the special system of confiscation measures to prevent crime is, firstly, prevent continuation in the future one way or another entity crime (at least prevention of repeat offenses); secondly, the restoration of social justice by, inter alia, the removal of a person guilty of a crime, money, property, other assets that were the subject of a criminal offense or who converted to any property (in other words, income from property, of offenses by); thirdly, redress or remedy damage caused by owner (rightful holder). So today criminal procedural decision on the special confiscation, and the issue of providing compensation for property damage caused by the lawful holder, received the necessary material (criminal law) framework, which is enshrined in section XIV of the General Part of the Criminal Code of Ukraine «Other activities criminal law». Thus for the first time in Ukraine at the legislative level given a formal definition of special confiscation, which is compulsory uncompensated seizure by the court to state ownership of money, valuables and other property subject to the crime in cases provided for in the Special Part of the Criminal Code of Ukraine.
