Правове регулювання засад територіального устрою як передумова для здійснення територіальної реформи

Abstract

Проаналізовано засади територіального устрою України, а також запропоновані науковцями та державотворцями пропозиції щодо їх удосконалення у зв’язку із необхідністю проведення територіальної реформи в Україні. Порівняно погляди сучасних дослідників і проекти нормативно-правових актів, які містять нові підходи до переліку та визначення змісту засад територіального устрою України. Запропоновано удосконалення правового регулювання засад територіального устрою як основ для його подальшої організації та розвитку. This article analyzes the existing principles of the territorial structure of Ukraine, as well as scholars and statesmen offered suggestions for their improvement in communication connection with the need for territorial reform in Ukraine. In particular, the research foundations such as the unity and integrity of the national territory, the combination of centralization and decentralization in the exercise of state power, balanced socio-economic development. A comparison of the views of modern scholars and draft legal acts that offer new approaches to determining the content of the list and the principles of territorial structure of Ukraine. Improvements regulation principles territorial system as the basis for its further construction and development. Great value for territorial reform in Ukraine has a legal definition of the principles of territorial division as the fundamental principles of its construction and operation. These principles are designed to ensure a stable and efficient development of all administrative units and is both a goal, which aims to realize the state sharing the territory of the state into components for the purpose of local government in them. The purpose of the article the principles of legal regulation of the territorial system, and propose improvements of their contents for possible further implementation of Ukraine’s territorial reform.The principles of territorial division as the basic ideas of its operation, the purpose of which is to promote the comprehensive development of territorial units shall be provided by the state and implemented in close relationship as they are complementary each other.
