Адміністративна відповідальність за адміністративні правопорушення спеціальних суб’єктів, на яких поширюється дія дисциплінарних статутів або спеціальних положень про дисципліну

Abstract

Розглянуто види адміністративної відповідальності, що призначаються спеціальним суб’єктам за адміністративні правопорушення на загальних підставах. До таких видів відповідальності належать: попередження; штраф; оплатне вилучення предмета, який став знаряддям учинення або об’єктом правопорушення; конфіскацію предмета, який став знаряддям учинення або об’єктом правопорушення чи грошей, отриманих унаслідок вчинення адміністративного правопорушення; позбавлення спеціального права, наданого громадянину. The article considers types of administrative liability, which is imposed to special subjects (military men and other persons who are subject to the disciplinary statutes) for administrative violations on general grounds. From the author’s point of view such types of liability are as following: warning; fine; compensated seizure of an item, which appeared to be the instrument or the direct object of an administrative offense; confiscation of an item which appeared to be the instrument or the direct object of administrative offense or money received as a result of committing an administrative offense; deprivation of a special right granted to the citizen. Based on the analysis the author upholds the introduction of a comprehensive reform of the legal responsibility of the military and those who are subject to disciplinary statutes, which should cover the contents and types of liability of special subjects; their legal status. This will allow to form the conceptual basis of legal liability of military men and persons who are subject to disciplinary regulations, based on an analysis of the current state of the mechanism of legal liability, taking into account international experience in attracting indicated subjects to legal liability and determine the direction of development of modern administrative legislation on the legal liability of special objects. Reasoning and fulfillment with the specific content of such a concept will allow to revise the legal basis of the administrative liability of the military and those who are subject to disciplinary statutes, to form a grounded proposals on improving the institution of administrative liability of the specified subjects, the order of bringing them to justice and improve measures to ensure proceedings on administrative offenses cases , committed by the military and persons who are subject to action of the disciplinary statutes.
