Природно-правова сутність та природа правової волі

Abstract

Стаття присвячена природі та сутності правової волі як філософсько-правової категорії, що розглядається як «наявне буття» реально існуючого. У роботі увага зосереджена на різних підходах до з’ясування природи правової волі; розкрито паралель права та волі. Акцентовано на проблемних моментах взаємодії права та волі як у формальному вираженні, так і в реально існуючому правовому полі. The article is devoted to the nature and essence of legal will, as philosophical and legal category which is examined as «present life» of real existing. In the research the attention is concentrated on the different approaches of finding out the nature of legal will, the parallel of right and will is defined. The problem moments of right and will co-operation both in formal expression and in the really existing legal field are revealed.
