Шляхи вдосконалення діяльності Національної поліції щодо забезпечення транспортної безпеки

Abstract

Проаналізовано шляхи вдосконалення діяльності Національної поліції щодо забезпечення транспортної безпеки у контексті адаптації національного законодавства України до вимог Європейського Союзу. Досліджено правоохоронні функції поліції щодо забезпечення безпеки транспортної інфраструктури та транспортних засобів у сфері правого регулювання діяльності поліції. Розглянуто пропозиції щодо змін в організаційно-штатній структурі територіальних органів Національної поліції, що безпосередньо повʼязано з підвищенням ефективності забезпечення транспортної безпеки. The continuation of aggression in the north of the state raises the issue of preventing terrorist acts, hooligan and extremist manifestations, man-caused accidents at the objects of transport infrastructure. At the same time, the police activity concerning transport safety needs further improvement. It is connected with new challenges and threats caused by the application of new types of weapons and technological features, which appear during the operation of various modes of transport, the technical component of the development of transport and control used to counteract various types of transport offenses. The administrative and legal mechanism to ensure transport safety by police includes the regulatory and protective norms of substantive law, procedural norms, the competence of the police to ensure transport safety at the objects of rail, water and air transport, and various measures of administrative coercion. This requires constant improvement of the theoretical and legislative component of transport safety and the practical activity of the police. Improvement of police activity in the field of transport safety is carried out at the legal and organizational level. In this regard, it is not enough to develop the legal framework for ensuring transport safety, it is necessary to create special units in the system of territorial transport police authorities, the duties of which will include issues of transport security in relation to the activity of a particular mode of transport. The analysis of the legislation on transport safety shows that the police are not the main subject of ensuring transport security. At the same time, it is difficult to provide effective protection of objects of transport infrastructure from acts of unlawful interference without the participation of the police carrying out measures to ensure transport safety. First, at the legislative level, it is necessary to include the transport police into the main subjects of providing transport safety, to add the departments of the National Police in rail, water and air transport to the list of transport safety units.
