Правова справедливість як засіб забезпечення соціальної цінності правових норм

Abstract

Актуальність дослідження зумовлена тим, що ево­люція ідеї справедливості тісно пов’язана зі змінами, що відбувались у політичних, економічних, правових та ре­лігійних сферах різних суспільств. Тож назріла потреба дослідити ті соціально-економічні та політичні умови, які супроводжували концептуалізацію «справедливості» за­галом і теоретико-правові детермінанти її сучасного розу­міння в правових нормах. У різних цивілізаціях та куль­турах вважалось, що право має бути справедливим. Право або розглядали як втілення справедливості, або висували мету сформувати його відповідно до неї. Relevance of the study due to the fact that the evolution of the idea of fairness is closely related to the changes that took place in the political, economic, legal and religious spheres of different societies. So there is a need to investigate those socio-economic and political conditions surrounding the conceptualization of “justice” in general and theoretical and legal determinants of modern understanding of justice ІП the law. Different civilizations and cultures believed that the law should be fair. Right or seen as the embodiment of justice, or put forward aim to form it according to justice.
