Адміністративна відповідальність керівників юридичних осіб за незабезпечення оповіщення військовозобовʼязаних працівників про їх виклик у військові комісаріати в процесі мобілізації

Abstract

Розглянуто проблемні питання притягнення керівників підприємств, установ та організацій до адміністративної відповідальності за незабезпечення оповіщення військовозобовʼязаних працівників про їх виклик у військові комісаріати в процесі оголошеної мобілізації. Доведено, що в Україні немає єдиної судової практики вирішення порушеного питання. Запропоновано вважати, що у період оголошеної мобілізації за невиконання законодавчо закріплених обовʼязків, які визначені у Законі України «Про мобілізаційну підготовку та мобілізацію», адміністративна відповідальність для керівників підприємств, установ та організацій повинна наставати виключно за ст. 210-1 «Порушення законодавства про оборону, мобілізаційну підготовку та мобілізацію» Кодексу України про адміністративні правопорушення. It is noted that according to the Ukrainian legislation, the heads or other officials responsible for the military record-keeping of officials working in enterprises, institutions, organizations of any form of ownership for failing to comply properly with the instructions of military commissars regarding the notification of subordinate workers about the call to military commissariats can be drawn both to the administrative and to the criminal liability. In the article the problem questions of attracting of leaders of enterprises, establishments and organizations, are considered to administrative responsibility for unproviding of notification of liable for military service workers about their call in soldiery commissariats in the process of the declared mobilization. It is proved that Ukraine has no common jurisprudence to resolve this issue, because there are cases when the leaders of legal entities are brought to administrative liability for similar offenses according to the Article 210-1 «Violation of legislation on defense, mobilization training and mobilization process» and of Article 211- 4 of Code of Ukraine on Administrative Offenses. This sanction is established in the form of imposing a fine for officials of enterprises and organizations in the amount from thirty to one hundred non-taxable minimum incomes, and is considerably stricter than the sanction of Article 211-4 of the Code of Ukraine on Administrative Offenses, which regulates the imposition of fines on the heads of legal entity in the amount from one to three non-taxable minimum incomes of citizens. It is suggested to assume that in the period of declared mobilization for nonfulfillment of legally stipulated duties, which are defined in the Law of Ukraine «On mobilization preparation and mobilization», administrative responsibility should come exclusively under Article 210-1 «Violation of legislation on defense, mobilization training and mobilization process» of the Code of Ukraine on Administrative Offenses.
