Реалізація конституційного оформлення правопорядку в умовах наявності конституційних ризиків

Abstract

Розкрито теоретичні підходи щодо реалізації конституційного оформлення правопорядку в умовах наявності конституційних ризиків. Проаналізовано порушення конституційної стабільності як загрозу для правопорядку та його конституційного оформлення, вплив конституційних перетворень на стан правопорядку і процес конституційного оформлення. Розглянуто нейтралізацію погроз і мінімізацію ризиків порушення правових приписів як важливу складову забезпечення правопорядку та роль органів публічної влади в системі забезпечення правопорядку в умовах мінімізації і усунення конституційних ризиків. Охарактеризовано діяльність Конституційного Суду України у сфері укріплення правопорядку. Окреслено напрями реалізації конституційного оформлення правопорядку. Обґрунтовано, що мінімізація конституційних ризиків і нейтралізація загроз зумовлюють реальні можливості якісного втілення ідеї конституційного оформлення правопорядку загалом. The harmonious functioning of the mechanism of ensuring law and order is provided by a qualitative and effective functioning of the basic document of the state – the Constitution, which establishes the constitutional and legal foundations of ensuring law and order, consolidates the bodies of public authority in the direction of its effective provision. In order to implement this, the legal doctrine develops the concept of a constitutional and legal mechanism to ensure law and order. Under present-day conditions, constitutionalization involves the formation of law and order, which ensures the rule of law and the supremacy of the Constitution. The degree of implementation of the Constitution shows the qualitative state of constitutional law and order in the state. The consistent implementation of constitutionalization helps to strengthen the constitutional law and order, determines and relates the effectiveness of the implementation of the constitutional legislation and the activities of public authorities. The article deals with theoretical approaches to implementation of constitutionalization of law and order in terms of constitutional risks. The violation of constitutional stability as a threat to the rule of law and its constitutional formulation, the influence of constitutional changes on the state of law and order and the process of constitutionalization are analyzed. The neutralization of threats and minimization of the risks of violation of legal requirements as an important component of ensuring law and order and the role of public authorities in the system of ensuring law and order in a context of minimization and elimination of constitutional risks are considered. The activity of the Constitutional Court of Ukraine in the feld of strengthening of law and order is described. The directions of implementing constitutional registration of law and order are outlined. It is substantiated that minimization of constitutional risks and neutralization of threats create real possibilities for a qualitative embodiment of the idea of constitutionalization of law and order in general.
