Порівняльний аналіз правового статусу нотаріальних архівів в Україні, Білорусі та Молдові

Abstract

У статті проводиться теоретичне дослідження порівняльного аналізу правового статусу нотаріальних архівів в Україні, Білорусі та Молдові. Розкриваються суть і поняття нотаріальних архівів в кожній із зазначених республік. В статті розглянуті законодавчі акти, що регулюють діяльність нотаріальних архівів в Україні, Білорусі та Молдові. Автором проведений порівняльний аналіз органів, на яких законодавством трьох республік покладено право зберігання нотаріальних документів. Виявлено спільні риси і відмінності в правовому регулюванні діяльності нотаріальних архівів в Україні, Білорусі та Молдові. Досліджуються шляхи удосконалення законодавства, що регулює діяльність нотаріальних архівів. The article conducts a theoretical study of the comparative analysis of the legal status of notarial archives in Ukraine, Belarus and Moldova. The essence and concept of notarial archives in each of the indicated republics are revealed. The article discusses the legislative acts regulating the activities of notarial archives in Ukraine, Belarus and Moldova. The author has made a comparative analysis of the bodies that are entrusted by the legislation of the three republics with the right to maintain notarial documents. The common features and differences in the legal regulation of the activity of notarial archives in Ukraine, Belarus and Moldova are revealed. Ways of improving the legislation regulating the activity of notarial archives are explored.
