Preservation of the territorial integrity of Ukraine in ATO conditions by criminal justice means

Abstract

Стаття присвячена аналізу сучасного стану боротьби з тероризмом в Україні в умовах антитерористичної операції. Автор вивчає особливості ведення кримінальних проваджень у зоні військових, надзвичайних ситуацій, зони проведення антитерористичної операції, включаючи особливості розслідування поведінки судді владою прокурора. Зроблено висновок, що боротьба з тероризмом та забезпечення територіальної цілісності України потребує невідкладних законодавчих змін та підвищення ефективності досудового розслідування на зазначеній території. Боротьба з тероризмом та забезпечення територіальної цілісності України потребують термінових законодавчих змін та посилення ефективності попереднього розслідування на зазначеній території. The article is devoted to the analysis of the current state of terrorism combating in Ukraine in the conditions of anti-terrorist operation. The author studies the peculiarities of criminal proceedings conducting in the area of military, emergency state, anti-terrorist operation zone, including the peculiarities investigating judge power’s conduction by the prosecutor. It is concluded that the terrorism combating and ensuring the territorial integrity of Ukraine requires urgent legislative changes and enhancement of the effectiveness of pre-trial investigation in the specified territory.
