Предмет і об’єкти державного контролю та нагляду в сфері охорони здоров'я

Abstract

У статті досліджено теоретико-правові підходи до розуміння сутності об’єкта та предмета контролю, у результаті чого надано визначення понять об’єкта та предмета державного контролю та нагляду за додержанням законодавства у сфері охорони здоров'я. Охарактеризовано сучасне нормативноправове підґрунтя закріплення об’єкта та предмета контролю за додержанням законодавства у сфері охорони здоров'я в Україні. Охарактеризована діяльність суб’єктів державного контролю та нагляду у сфері охорони здоров’я. Проаналізовано та узагальнено основні положення, які перевіряються під час здійснення державного контролю за додержанням законодавства у сфері охорони здоров'я. Зроблено висновок про наявність єдиного предмета і об'єкта при здійсненні державного нагляду та контролю різними відомствами. Попри всі спроби вчених щодо уніфікації критеріїв, в науці адміністративного права виділені відмінні риси державного нагляду за спрямованістю або предметом. Предметом правового регулювання можуть виступати якісна медична допомога, санітарно-епідеміологічне благополуччя, трудова діяльність в умовах безпеки, промислова безпека, сприятливе навколишнє середовище, права споживачів послуг, забезпечення законних інтересів організацій. Об'єктами державного нагляду та контролю є діяльність юридичних і фізичних осіб, що здійснюється в межах встановлених норм. The article examines the theoretical and legal approaches to understanding the essence of the object and subject of control, resulting in the defnition of the concept of object and subject of state control and supervision of compliance with legislation in the feld of health care. The modern normative-legal basis of consolidation of the object and subject of control over the observance of the legislation in the feld of health care in Ukraine is characterized. The activity of the subjects of state control and supervision in the feld of health care is described. The main provisions that are checked during the implementation of state control over compliance with legislation in the feld of health care are analyzed and summarized. It can be concluded that there is a single subject and object in the implementation of state supervision and control by various agencies. Despite all the attempts of scholars to unify the criteria, in the science of administrative law there are distinctive features of state supervision over the direction or subject. As a subject of state supervision and control in the feld of health care, it is proposed to consider important for the security of the state and the individual health care requirements governing public relations, which consist of providing executive authorities to verify compliance with legal requirements by legal entities and individuals. in order to ensure the rights of workers and the public. The subject of legal regulation may be quality medical care, sanitary and epidemiological well-being, work in safety, industrial safety, a favorable environment, the rights of consumers of services, ensuring the legitimate interests of organizations. The objects of state supervision and control are the activities of legal entities and individuals, carried out within the established norms. The subject of scheduled inspections, as one of the measures of control and supervision of executive authorities, is compliance with legal and natural persons-entrepreneurs in the process of carrying out the activities of the set of mandatory requirements. In terms of improving state control and supervision within the risk-oriented approach, it is envisaged to limit the subject of scheduled inspections to lists of issues that reflect the content of mandatory requirements.
