Abstract

У монографії проведено комплексне дослідження актів тлумачення норм права. Розкрито структуру актів офіційного та неофіційного тлумачення норм права, під якою пропоновано розуміти їхню будову, тобто розташування основних елементів і зв’язків, які забезпечують збереження їхніх (актів) необхідних властивостей та функцій при впливі на них різноманітних внутрішніх і зовнішніх, об’єктивних і суб’єктивних чинників правової дійсності. Виявлено та схарактеризовано особливості процесу оприлюднення актів тлумачення норм права. Комплексно проаналізовано дію актів тлумачення норм права в часі, просторі та за колом осіб з докладним висвітленням найбільш диску¬сійних теоретичних і практичних аспектів проблеми. Розглянуто питання забезпечення ефек¬тив¬ності актів тлумачення норм права, з огляду не лише на їхню формальну (юридичну) ефективність, а й на економічність, корисність, істинність, со¬ціальну цінність та інші характеристики. The monograph contains a comprehensive study of the acts of interpretation of the norms of law. The structure of acts of the official and unofficial interpretation of the norms of law is revealed, under which it is proposed to understand their structure, that is, the arrangement of the main elements and connections that ensure the preservation of their (acts) of the necessary properties and functions when influenced on them by a variety of internal and external, objective and subjective factors of legal reality. The peculiarities of the process of the publication of acts of interpretation of the norms of law were identified and characterized. Comprehensive analysis of the acts of interpretation of the norms of law in time, space and beyond, with a detailed coverage of the most discursive theoretical and practical aspects of the problem. The issues of ensuring the effectiveness of acts of interpretation of the norms of law are considered, taking into account not only their formal (legal) efficiency, but also the efficiency, usefulness, truth, social value and other characteristics.
