Класифікація судових експертиз: польській підхід

Abstract

Стаття презентує огляд польського підходу до питання класифікації судових експертиз у кримінальному провадженні. На підставі аналізу польської наукової літератури криміналістичного спрямування автором виділено чотири критерії (галузь науки, мистецтва чи вмінь; спосіб опрацювання експертизи; процесуальна позиція експертизи; обов’язок скористатися послугами експерта), у межах яких розглянуто понад тридцять п’ять видів та підвидів судових експертиз. Водночас зауважено, що проведену класифікацію не слід вважати вичерпною, адже судова експертиза як правовий інструмент постійно розвивається для якісного забезпечення цілей отримання висновку експерта та використання його в суді. The article presents a review of the Polish approach to the classification of forensic examinations in criminal proceedings. On the basis of the analysis of Polish scientific literature in the forensic field, the author identified four criteria (the branch of science, art or skills; the way of processing the examination; the procedural position of the examination; the duty to use forensic expert services), in which more than thirty five species and subspecies of forensic examinations have been considered. At the same time, particular attention has been paid to the fact that the suggested classification should not be considered as finished, because forensic examinations as a legal tool is constantly evolving for the aim of ensurance the quality of expert’s opinion and using them in the court.
