Поняття та сутність протидії втягненню неповнолітніх у злочинну діяльність як цивілізаційного супротиву одному з проявів злочинності

Abstract

Проаналізовано поняття протидії втягненню неповнолітніх у злочинну діяльність як цивілізаційного супротиву зростанню злочинності загалом і вказаному злочину зокрема. Аргументовано доцільність вживання терміна «протидія» на означення системи цивілізаційно-правових зусиль, спрямованих на недопущення вчинення кримінального правопорушення, пов’язаного із втягненням у нього неповнолітнього, й адекватну реакцію у разі його вчинення. З урахуванням новітньої сутності злочинності запропоновано авторське бачення поняття протидії їй щодо досліджуваного злочину. The concept of counteracting juveniles’ involvement in criminal activity as a civilizational opposition to the growth of criminality in general and the specified crime in particular is analyzed in the article. The expediency of using the term «counteraction» as a system of civilizational and legal efforts aimed at preventing the commission of criminal offenses by juveniles and an adequate reaction in case of their commission is proved. Taking into account the newest essence of crime and its manifestations, the author suggests his understanding of the concept of counteraction in the part of the investigated crime. The essential features of the indicated activity as the state and civil society opposition to the destructive forms of behavior of certain members of society with the purpose of minimization and liquidation of the consequences of their criminal activity are determined, as well as the scientific positions of particular scientists are considered. It has been established that specific relations with the subject-object character in contrast to the general-social and special-criminological counteraction arise in relation to illegal acts of persons’ behavior on the involvement of children in criminal activity and reporting such facts by operative units of criminal police. An attempt has been made to reveal the content of the notion of counteraction to crime through the prism of the problem under study, during which it has been stated that it represents a system of interrelated elements of a hierarchical type, each of which has its functional purpose and in general acts as an integral part of the mechanism, which opposes to the crime functioning, to certain types of crimes, as well as determinants that lead to their existence. Based on the analysis of scientific opinions, it has been emphasized that combating crime has two main areas, such as prevention and reaction. Prevention as a complex of means of prevention and termination is a component of a wider phenomenon and the corresponding notion of «counteraction to crime».
