Актуальні питання розмежування понять «державна допомога» та «державна підтримка» в сфері господарювання

Abstract

У статті досліджуються поняття «державна допомога» та «державна підтримка» у сфері господарювання через призму вимог і умов, що визначені в Угоді про асоціацію України з ЄС. Проаналізовано вітчизняне та міжнародне законодавство, а також дослідження вчених у сфері державної допомоги та підтримки суб’єктам господарювання щодо сутності та співвідношення досліджуваних понять. Встановлено розбіжності, ототожнення та неоднозначність у трактуванні понять, що містяться в законодавстві. В статті обумовлюється необхідність та деталізація розмежування понять державної допомоги і підтримки суб’єктам господарювання на основі встановлення змісту та сутності понять, що досліджуються. The article examines the concepts of "state aid" and "state support" in the economic sphere through the prism of requirements and conditions defined in the Agreement on Association of Ukraine with the EU. National and international legislation is analyzed, as well as researches of scientists in the field of state aid and support to economic entities regarding the nature and relation of the studied concepts. The discrepancies, identifications and ambiguities in the interpretation of the concepts contained in the legislation are established. The article stipulates the necessity and detail of the distinction between the concepts of state aid and support to economic entities on the basis of establishing the content and nature of the concepts under study.
