Implementation of human rights in the conditions digital transformation (analysis of today's situation in Ukraine)

Abstract

Стрімкий розвиток технологічних інновацій, зміни в усталених міжлюдських відносинах, виникнення нових форм ведення бізнесу, розвиток інформаційних систем та збільшення частки онлайн-життя людини в сучасному соціумі неабияким чином впливають на щораз зростаючі виклики для права, як соціального регулятора та юридичної практики в цілому. Такі важливі цінності як свобода, справедливість, верховенство права та права людини закономірно постають перед обличчям численних новітніх загроз, а їх захист потребує вироблення нових юридичних механізмів їх охорони та захисту. Аналіз впливу цифрових технологій на права людини та розвиток демократії у статті здійснюється на основі системного аналізу двох аспектів. Перший обумовлений ґенезою розвитку технічного прогресу та юридичне оформлення його досягнень. Другий – відображає тенденції цифрового розвитку на міжнародному та національному рівнях. Він пов'язаний з глобальним виміром технологічних явищ, що розглядаються: вплив комп'ютерних мереж на людину іноді піддає її права негативному впливу. У світлі цих двох підходів метою пропонованої статті є комплексний аналіз двох ключових питань: 1) як розвиваються традиційні права людини під впливом технологічних інновацій; 2) яка ґенеза формування нових видів прав людини, які визначаються як «цифрові» права. У статті значна увага приділяється дослідженню проблем впливу цифрових технологій на права людини та розвиток демократичних інститутів влади та суспільства. Ці технології відкривають принципово нові можливості для оптимізації діяльності держави з метою захисту основних прав і свобод людини та громадянина, суверенітету, територіальної цілісності та національної безпеки сучасної держави. Зазначено, що цифрова трансформація впливає як на теорію прав людини, так і на практику їх реалізації. Це сприяє появі нових концепцій у сфері прав людини, нових інститутів і механізмів їх правового захисту, позитивно відображаючись на практичній стороні реалізації, охорони та захисту нового покоління прав людини. Безперечно, це закріплено в міжнародних стандартах та національному законодавстві, яке має відображати існуючі тенденції. Зроблено висновок, що цифрові технології позитивно впливають на реалізацію прав людини, відкриваючи нові можливості для їх захисту та захисту, а також нові напрямки міжнародного співробітництва в цій сфері. Цифрова революція формує нові права в цифровому просторі Інтернету, інших інформаційно-комунікаційних технологій, надає нові, часом несподівані аспекти реалізації основних прав і свобод громадян. Позитивний вплив цифрових технологій на права людини реалізується в тому, що вони відкривають нові можливості для реалізації прав людини як особистих, політичних, соціальних, економічних та культурних. Abstract. The rapid development of technological innovations, changes in established interpersonal relationships, the emergence of new forms of business, the development of information systems and the increase in the share of online human life in modern society have a significant impact on the ever-growing challenges for law as a social regulator and legal practice as a whole. Such important values as freedom, justice, the rule of law and human rights naturally face numerous new threats, the protection of which requires the development of new legal mechanisms for their protection and protection. The analysis of the impact of digital technologies on human rights and the development of democracy in the article is based on a systematic analysis of two aspects. The first is determined by the genesis of the development of technical progress and the legal registration of its achievements. The second one reflects the trends of digital development at the international and national levels. It is related to the global dimension of the technological phenomena under consideration: the influence of computer networks on a person sometimes exposes his rights to negative influence. According to these two approaches, the purpose of the proposed article is a comprehensive analysis of two key questions: 1) how traditional human rights develop under the influence of technological innovations; 2) what is the genesis of the formation of new types of human rights, which are defined as "digital" rights. The article pays considerable attention to the study of the impact of digital technologies on human rights and the development of democratic institutions of government and society. These technologies open up fundamentally new opportunities for optimizing state activity in order to protect the basic rights and freedoms of a person and citizen, sovereignty, territorial integrity and national security of a modern state. It is noted that digital transformation affects both the theory of human rights and the practice of their implementation. This contributes to the emergence of new concepts in the field of human rights, new institutions and mechanisms of their legal protection, positively reflecting on the practical side of the implementation, protection and protection of a new generation of human rights. Undoubtedly, this is enshrined in international standards and national legislation, which should reflect existing trends. It was concluded that digital technologies have a positive effect on the realization of human rights, opening up new opportunities for their protection and protection, as well as new directions of international cooperation in this area. The digital revolution forms new rights in the digital space of the Internet and other information and communication technologies, provides new, sometimes unexpected aspects of the realization of the basic rights and freedoms of citizens. The positive impact of digital technologies on human rights is realized in the fact that they open up new opportunities for the realization of human rights as personal, political, social, economic and cultural.
