Criminal remedies of counteraction to falsification of COVID-19 test results

Abstract

Проведено комплексне порівняльно-правове дослідження законодавства Грузії, Республіки Польща та України в частині регулювання відповідальності за підробку документів, що засвідчують факт дослідження на COVID-19, а також аналіз правозастосовної та судової практики щодо цієї категорії справ. Встановлено типові помилки щодо притягнення осіб, у тому числі медичних працівників, до кримінальної відповідальності за вказані суспільно небезпечні діяння. Визначено можливі шляхи удосконалення кримінального законодавства, а також законодавства інших галузей права в частині регулювання відповідальності за поширення різних видів інфекційних хвороб. Given the above, comprehensive comparative legal research of the legislation of Georgia, the Republic of Poland and Ukraine in terms of regulation of liability for forgery of documents certifying the fact of the research for COVID-19, analysis of law enforcement and judicial practice in this category of cases; establishment of typical mistakes related to bringing individuals, including medical workers, to criminal responsibility for specified socially dangerous acts; identification of possible ways to improve criminal law, as well as legislation of other branches of law in terms of regulating liability for the spread of various types of infectious diseases is a purpose of this article.
