Концептуальні основи сутності та змісту моделі правоохоронної діяльності, орієнтованої на певну проблематику (Problem-Oriented Policing)

Abstract

Статтю присвячено дослідженню та висвітленню концептуальних основ сутності та змісту моделі правоохоронної діяльності, орієнтованої на певну проблематику (Problem-Oriented Policing). Визначено, що досліджувана модель організації правоохоронної діяльності є проактивним підходом до упереджувального впливу на детермінуючі протиправну поведінку чинники, згідно якої зусилля та ресурси правоохоронців застосовуються на виявлення та аналіз конкретних проблем злочинності та порушень громадського порядку з метою розробки ефективних стратегій реагування на них, а також оцінки ефективності впливу на вирішення таких проблем. Констатовано, що проблемно-орієнтований підхід прагне ідентифікувати закономірності різних злочинних подій, з метою визначити причини цих проблем на основі яких відбувається розроблення унікальних рішень, пристосованих до причин проблем, з увагою до оцінки ефективності таких рішень. Таким чином вирішуються повторювані проблеми у стані криміногенної ситуації, що у підсумку створює проактивний підхід до запобігання протиправним проявам у майбутньому. Установлено, що під час реалізації проактивної моделі Problem-Oriented Policing використовують методологію “Трикутник аналізу проблем” (аналітична діяльність, яка спрямована на пошук пояснення того, як і чому відбувається прояв кримінальної поведінки). Також під час реалізації правоохоронної діяльності, орієнтованої на певну проблематику (Problem-Oriented Policing) використовують методологію SARA (процес ідентифікації проблем, їх поглибленого аналізу, розроблення заходів реагування, оцінки та коригування ефективності контрзаходів), що дозволяє сформувати передумови для розуміння закономірностей проблем злочинності з метою розробки персональних заходів для вирішення основних умов, які викликають такі проблеми. The article is devoted to research and elucidation of the conceptual foundations of the essence and content of the model of law enforcement activity oriented to a certain problem (Problem-Oriented Policing). It was noted that the researched model of the organization of law enforcement activities is a proactive approach to the prejudicial influence on the determining factors of illegal behavior, according to which the efforts and resources of law enforcement offcers are used to identify and analyze specifc crime problems and are activated publicly in order to develop effective strategies for responding to them, as well as evaluating effective influence on solving such problems. It was established that the problem-oriented approach seeks to identify patterns of various criminal events, with the aim of determining the causes of these problems, on the basis of which the development of unique solutions adapted to the causes of problems takes place, with attention to the evaluation of the effectiveness of such solutions. In this way, recurring problems in the state of a criminogenic situation are solved, which ultimately creates a proactive approach to preventing illegal manifestations in the future. It has been established that during the implementation of the proactive model of Problem-Oriented Policing, the methodology “Triangle of problem analysis” is used (analytical activity aimed at fnding an explanation of how and why the manifestation of criminal behavior occurs). Also, during the implementation of law enforcement activities focused on a certain problem (Problem-Oriented Policing), the SARA methodology is used (the process of identifying problems, their in-depth analysis, developing response measures, evaluating and adjusting the effectiveness of countermeasures), which makes it possible to form prerequisites for understanding the patterns of crime problems with the goal of developing personal interventions to address the underlying conditions that cause such problems.
