Концептуальні основи (сутність та поняття) моделі здійснення правоохоронної діяльності, орієнтованої на потреби громад (Community policing, СoР)

Abstract

Статтю присвячено дослідженню концептуальних основ реалізації сучасної проактивної моделі правоохоронної діяльності орієнтованої на потреби громад (Community policing, СoР). Фундаментальною особливістю досліджуваної моделі правоохоронної діяльності є те, що основні зусилля поліції скеровуються не лише на протидію злочинності та підтримання правопорядку, а й на розбудову стійких та постійних довірливих відносин та побудову шляхів комунікації з представниками територіальних громад, які є носіями інформації про проблеми громади та володіють потенціалом, який можна використовувати для їх запобігання та нейтралізації. Констатовано, що концептуально модель правоохоронної діяльності орієнтованої на потреби громад (Сommunity policing) є соціально-орієнтованою правоохоронною діяльністю, і організаційною стратегією, за якою поліцейські підрозділи поряд із реагуванням на кримінальні правопорушення та порушення громадської безпеки та їх розгляд застосовують поглиблено залучення громадських груп і громадян (представників громадськості) до спільного формування безпекового простору, через запобігання та вирішення індивідуальних проблем, загроз та ризиків, які властиві конкретним територіальним громадам. Також установлено, що організаційно проактивна модель правоохоронної діяльності орієнтована на потреби громад (Community policing) складається з таких елементів: залучення громадян до виявлення та вирішення проблем громадської безпеки; децентралізація прийняття рішень для вироблення відповідей на локально визначені проблеми та застосування контрзаходів для вирішення проблем. Розбудова та підтримання дієвого та сталого двохстороннього співробітництва між правоохоронними органами та представниками громадськості є запорукою упереджувального впливу на виникнення та поширення злочинності та супутніх проблем. The article is devoted to the study of the conceptual foundations of the implementation of a modern proactive model of law enforcement activity oriented to the needs of communities (Community policing, CoR). A fundamental feature of the investigated model of law enforcement activity is that the main efforts of the police are directed not only to combating crime and maintaining law and order, but also to building stable and permanent trusting relationships and building communication channels with representatives of territorial communities who are carriers of information about community problems and have potential that can be used to prevent and neutralize them. It was established that conceptually, the model of community policing is a socially oriented law enforcement activity, and an organizational strategy according to which police units, along with responding to criminal offenses and violations of public safety and their consideration, apply in-depth involvement of public groups and citizens (representatives of the public) to the joint formation of a safe space, through the prevention and resolution of individual problems, threats and risks that are characteristic of specifc territorial communities. It has also been established that an organizationally proactive model of law enforcement activities focused on the needs of communities (Community policing) consists of the following elements: involvement of citizens in identifying and solving public security problems; decentralization of decision-making to develop responses to locally identifed problems and use countermeasures to solve problems. The development and maintenance of effective and stable bilateral cooperation between law enforcement agencies and representatives of the public is the key to a preventive effect on the occurrence and spread of crime and related problems.
