Підтримання та збереження публічної безпеки та порядку за допомогою поліцейської роботи, заснованої на знаннях та вміннях

Abstract

Досліджено питання тактики роботи поліції щодо підтримання та збереження публічного порядку та безпеки під час зібрань громадян, оскільки досить часто робота поліції з підтримання та збереження публічного порядку і безпеки формується на думці та припущеннях, що великі зібрання людей (демонстрації, натовпи, мітинги тощо) за своєю природою є нераціональні та дуже небезпечні. Таку думка є як помилковою, так і контрпродуктивною, тому що це може призвести до проведення поліцейських операцій таким чином, що вони посилюватимуть негативний вплив на людей, які приймають участь у зібраннях, мітингах, демонстраціях тощо та підбурюватимуть їх до насильства та порушення порядку. Розроблено основні правила та рекомендації/інструкції для того, яким чином поліцейські можуть працювати та діяти для того, щоб зменшити ризик вибуху насильства всередині людських зібрань та примусити людей - учасників та членів цих людських зібрань власноруч (власними силами) здійснювати нагляд та контроль за угрупованнями агресивно налаштованих та схильних до насильства людей, що також знаходяться всередині даних людських зібрань (підтримання та збереження порядку власноруч самими учасниками демонстрацій або людських зібрань). Робота поліції, яка базується на знаннях та вміннях, може перетворити перебіг подій та того, що відбувається всередині людського зібрання на можливість подолати та владнати важкокеровані конфлікти між поліцейськими та різними групами суспільства. The right to freedom of peaceful assembly is enshrined in a number of international human rights instruments and guaranteed by the 1990 OSCE Copenhagen Document. At the same time, ensuring the right to freedom of assembly may prove to be a difficult task for the authorities. This task is especially difficult for the police, which bears the main responsibility for ensuring the possibility of holding meetings and at the same time for preventing disproportionate restrictions on the rights and freedoms of other people and maintaining public order. The purpose of this article is to propose police guidelines for the enforcement of the right to freedom of peaceful assembly in accordance with the Scandinavian model of public order and security. The question of the tactics of police work in maintaining and preserving public order and during public gatherings has been studied, quite often the work of the police in maintaining and preserving public order and safety is formed on the basis of opinions and assumptions that the largest gathering of people (demonstrations, crowds, meetings, etc.) by its nature are irrational and very dangerous. This thinking is both wrong and counterproductive because it can lead to policing in a way that exacerbates the negative impact on people participating in assemblies, rallies, demonstrations, etc. and encourages them to engage in violence and disorder. Basic rules and recommendations/instructions have been developed for how the police can work and act in order to reduce the risk of population explosion within human gatherings and to force the people – participants and members of these human gatherings by the owner (with their own forces) to supervise and control the grouping aggressively violent and alienated people who are in the middle of these human gatherings (maintenance and preservation of order by the participants of demonstrations or human gatherings themselves). knowledge and skills-based policing can transform the course of events and what happens in a human assembly into an opportunity to overcome and resolve complex conflicts between robot-police and other groups in society.
