До питання становлення та реформування інституту адвокатури в Україні: історико-правовий аспект

Abstract

Щоби створити правову державу та громадянське суспільство в Україні, необхідно забезпечити гарантії захисту прав і законних інтересів громадян. У статті було проаналізовано процес становлення та реформування інституту адвокатури в Україні. Зазначено, що формування інституту відбувалося на засадах професійності, самоврядності, незалежності та поєднання у діяльності адвокатів функцій судового представництва і судового захисту. Розглянуто основні етапи формування адвокатури в Україні, включаючи період перед революцією 1917 року, радянський період і сучасну епоху. У статті окреслюються головні проблеми та виклики, з якими зіткнувся інститут адвокатури протягом свого розвитку. Було визначено основні передумови, з якими пов’язано створення інституту адвокатури. Розглядаються ключові законодавчі акти, які визначають статус і функції адвокатів в сучасній Україні. To create a legal state and civil society in Ukraine, it is necessary to ensure the protection of the rights and legitimate interests of citizens, as well as the effective functioning of the legal profession as a specific democratic institution. The bar, having its characteristics, structure, and legal principles, is an important legal institution of any developed state. The article analyzed the process of formation and reform of the Institute of Advocacy in Ukraine. The history of the development of advocacy shows that for a long period, the importance of this profession was belittled, and also that the legislative regulation of its activity was insufficient. This is since due to the specificity of the functions performed by the legal profession, state authorities in different periods of history treated it differently. It is noted that the formation of this institute took place based on professionalism, self‐ government, independence, and combining the functions of legal representation and legal defense in the activities of lawyers. The main stages of the formation of the legal profession in Ukraine are considered, including the period before the 1917 revolution, the Soviet period, and the modern era. The article outlines the main problems and challenges faced by the Institute of Advocacy during its development. The main prerequisites for the formation of the legal profession institute were determined. Key legislative acts that determine the status and functions of lawyers in modern Ukraine are considered. The article also draws attention to the role of the legal profession in ensuring democracy and legal statehood in Ukraine. The development of an independent Ukraine requires the creation of an effective and objective institute of lawyers capable of protecting the rights and interests of citizens. However, the formation of modern advocacy is impossible without using the experience of previous generations. Therefore, today there is a need to research the history and role of lawyers in the territory of Ukraine.
