Правове регулювання діяльності органів публічного управління в умовах цифрової реальності

Abstract

У статті розглянуто у теоретико-правовому аспекті питання правового регулювання діяльності органів публічного управління в умовах цифрової реальності. Методологічну основу склали: системний метод, що використовується для розкриття цифрової реальності як певної системи; структурно-функціональний метод, що дозволив виявити зміни структури та функцій публічних структур, приватно-наукові методи аналізу правових явищ. На основі аналізу розвитку цифрової реальності розкрито основні зміни, що відбуваються під впливом цифрових інформаційно-комунікаційних технологій у діяльності публічної влади та інститутів громадянського суспільства – цифровізація, поява нових форм взаємодії на цифрових платформах, реалізація адміністративних послуг у цифровій формі. Вказано, що формування та розвиток цифрової реальності як багатоаспектного утворення, що у змістовному аспекті є конвергенцією природної та штучної реальності, призвели до істотних змін у публічному управління щодо взаємодії держави та інститутів громадянського суспільства, підвищивши її ефективність через цифровізацію надання адміністративних послуг, електронний документообіг. Зазначено, що еволюція державного управління, комунікативних процесів, владних відносин багато в чому обумовлена розвитком цифрових технологій але, як будь-які технології, дані технології можуть мати різну спрямованість, що потребує переосмислення ролі держави, інститутів громадянського суспільства, форм взаємодії у новій цифровій реальності. Розкрито тенденції подальших змін цифрової реальності у ракурсі створення цифрової економіки та показано їх вплив на становлення цифрової держави, визначено їх вплив на трансформацію механізмів взаємодії держави та інститутів громадянського суспільства у процесах публічного управління, комунікацій та реалізації відносин влади. The article considers the issue of legal regulation of the activities of public administration bodies in the conditions of digital reality from the theoretical and legal aspects. The methodological basis consisted of: a system method used to reveal digital reality as a certain system; the structuralfunctional method, which made it possible to identify changes in the structure and functions of public structures, private-scientific methods of analysis of legal phenomena. Based on the analysis of the development of digital reality, the main changes taking place under the influence of digital information and communication technologies in the activities of public authorities and institutions of civil society are revealed - digitalization, the emergence of new forms of interaction on digital platforms, the implementation of administrative services in digital form. It is indicated that the formation and development of digital reality as a multifaceted formation, which in the content aspect is the convergence of natural and artificial reality, has led to significant changes in public administration regarding the interaction of the state and institutions of civil society, increasing its effectiveness through the digitization of the provision of administrative services, electronic document flow. It noted that the evolution of state administration, communication processes, and power relations is largely due to the development of digital technologies, but, like any technology, these technologies can have different orientations, which requires a rethinking of the role of the state, institutions of civil society, and forms of interaction in the new digital reality. The trends of further changes in digital reality from the perspective of creating a digital economy revealed and their impact on the formation of a digital state is shown, their impact on the transformation of mechanisms of interaction between the state and civil society institutions in the processes of public management, communications and implementation of power relations is determined.
