Достовірність доказів у світлі належного доказування у кримінальному провадженні

Abstract

Стаття присвячена аналізу проблематики оцінки достовірності доказів у кримінальному процесі, яка завжди була сферою наукових інтересів, як провідних вчених, так і молодих науковців. Така зацікавленість є абсолютно закономірною, враховуючи вагомість та значення процесу доказування у кримінальній процесуальній діяльності. У статті розглядається така властивість доказу, як його достовірність, оскільки саме від правильного розуміння її природи залежить дотримання прав і свобод учасників кримінального процесу, забезпечення гарантій та дотримання засад кримінального судочинства, встановлення істини та вирішення завдань кримінального провадження у цілому. Підкреслено, що реалізація завдань кримінального процесу залежить, передусім, від доказування фактів та обставин, що становлять предмет доказування в конкретному кримінальному провадженні. Наголошено, що єдиним засобом досягнення цілей кримінального судочинства є доказування, яке розглядається як процес одержання доказів, їх залучення до сфери кримінального судочинства та має на меті максимальне відтворення минулої події кримінального правопорушення, яка досліджується, захист прав та законних інтересів усіх осіб, які беруть участь у кримінальному судочинстві, незалежно від їх процесуального статусу, викриття винних та недопустимість покарання невинуватих. Реалізація функцій судової влади за межами зали судового розгляду неможлива апріорі. Саме тому, питання доказів і доказування, на думку переважної більшості науковців, є й залишаються основою кримінального процесу. The article is devoted to the analysis of the problem of assessing the credibility of evidence in the criminal process, which has always been the field of scientific interests of both leading scientists and young scientists. Such interest is absolutely natural, taking into account the weight and importance of the evidence process in criminal procedural activity. The article examines such a property of evidence as its reliability, since it is from a correct understanding of its nature that the observance of the rights and freedoms of the participants in the criminal process, the provision of guarantees and compliance with the principles of criminal justice, the establishment of the truth and the resolution of the tasks of criminal proceedings as a whole depends. It is emphasized that the implementation of the tasks of the criminal process depends, first of all, on proving the facts and circumstances that are the subject of proof in a specific criminal proceeding. It is emphasized that the only means of achieving the goals of criminal justice is proof, which is considered as a process of obtaining evidence, their involvement in the field of criminal justice and has the goal of maximal reproduction of the past event of a criminal offense that is being investigated, protection of the rights and legitimate interests of all persons who participate in criminal proceedings, regardless of their procedural status, the exposure of the guilty and the inadmissibility of punishing the innocent. Implementation of the functions of judicial power outside the courtroom is impossible a priori. That is why, according to the vast majority of scientists, issues of evidence and proof are and remain the basis of the criminal process.
