Адміністративно-правові аспекти взаємодії місцевих державних адміністрацій та органів місцевого самоврядування: автореферат

Abstract

У межах науки адміністративного права України на основі системного підходу здійснено комплексне дослідження особливостей та закономірностей взаємодії місцевих державних адміністрацій та органів місцевого самоврядування, досліджено основні форми такої взаємодії, запропоновано шляхи удосконалення чинного законодавства України з метою досягнення ефективності взаємодії місцевих державних адміністрацій та органів місцевого самоврядування. Зроблено висновок, що правове регулювання взаємодії місцевих державних адміністрацій та органів місцевого самоврядування повинно враховувати історичні моделі взаємодії місцевих органів публічної влади. Особливості взаємодії місцевих державних адміністрацій та органів місцевого самоврядування досліджено крізь призму таких її видів, як координаційна, субординаційна та реординаційна. У науковій роботі розмежовано принципи організації та діяльності місцевих державних адміністрацій та органів місцевого самоврядування та принципи, які лежать в основі їх взаємодії. The thesis deals with the comprehensive research of administrative and legal aspects of cooperation between the local state authorities and bodies of selfgovernment. The thesis researches historical progress of legal regulation development of cooperation between local state administrations and local self-government bodies in Ukraine. The author indicates that the centralization of power in Kyivan Rus, especially during the reign of Volodymyr the Great, did not contribute to cooperation between the prince’s (public) power and communities’ power. Further historical development of local public authorities cooperation throughout the Ukrainian lands depended on local self-government development and its essence: either strengthening of municipalism in Cossack time, a period of national liberation movements, or its weakening when the Ukrainian lands were a part of foreign countries. Soviet period of legal regulation development was based on the principles of councils’ sovereignty and democratic centralism. The elaboration of modern legal principles of cooperation between local state administrations and local selfgovernment bodies should be based on historical models of their coexistence and collaboration. The author analyzes and generalizes the definition of «cooperation» concept, elucidated in the scientific literature, in particular he investigates the etymology of this term and sheds light on the understanding of this category basing on different sciences, such as philosophy, sociology, management theory, military affairs and, of course, jurisprudence. The author describes opinions, suggested in scientific literature, with the regard to typical features of «cooperation» concept, expresses critical remarks and offers his own view on key typical features of the concept. According to the author, these features include joint activities, several (at least two) subjects of cooperation and common goal for all the cooperating subjects. Through the prism of cooperation features, viewed as a legal category, the author’s concept of «cooperation» is defined as purposeful, structured and coordinated activity (process) of at least two subjects, who exert influence on each other by their inherent methods and ways in order to achieve a common goal and obtain the expected result. The author uses such definition as the basis to explain the concept «cooperation between bodies of local state authorities and self-government». The thesis also researches differentiation of powers between local bodies of public authority and bodies of local self-government in the light of a legal notion «local significance issues». Thorough analysis of specific features of the legal notion , provided by the author, could be adopted as the basis of its legal definition. The author investigates system of legal principles of cooperation between local state authorities and self-government bodies as a key element of building interaction between them. Based on the analysis of doctrinal views concerning understanding of the notion of principle and in particular suggested in academic literature classifications of principles of cooperation between legal principles of local state authorities and self-government bodies the author concludes that the a number of these principles could be deduced from the principles of functioning of the corresponding local public authorities. However, despite their similarity, and in some aspects coincidence, one should not to identify the principles of organization and functioning of local state authorities and self-government bodies with the principles which lay at the basis of their cooperation. The following formulation of these principles is suggested: responsibility towards the individual and the state for their activities; rule of law; legality; priority of human rights; publicity; combination of state and local interests; legal, organizational, material and financial independence within the powers provided by laws; government support and guarantees of local self-government, etc.
