Abstract

Дисертація є комплексним дослідженням, присвяченим основним аспектам застосування заходів заохочення та стягнення до осіб, позбавлених волі на певний строк. У роботі, зокрема, проаналізовано стан теоретичного дослідження питань застосування заходів заохочення та стягнення до осіб, позбавлених волі на певний строк, а також історичну ґенезу закріплення заходів заохочення та стягнення у законодавстві України на різних етапах розвитку. Досліджено поняття і види заходів заохочення та стягнення, що застосовуються до осіб, позбавлених волі на певний строк, а також підстави і порядок їх застосування. Відтак встановлено необхідність вивчення особи засудженого впродовж усього строку відбування покарання та обов’язкове врахування співрозмірності застосованого заходу стягнення залежно від тяжкості вчиненого засудженим дисциплінарного проступку. На основі проведеного анкетування здійснено кримінально-правову, кримінологічну та кримінально-виконавчу характеристику осіб, позбавлених волі на певний строк, до яких застосовувалися заходи заохочення та стягнення. З’ясовано місце заходів заохочення та стягнення у виправленні засуджених. За результатами дослідження розроблено низку пропозицій щодо внесення змін і доповнень до статей КВК України, що регулюють питання застосування заходів заохочення та стягнення до осіб, позбавлених волі на певний строк.The research is focused on the complex study of the basic aspects of administration of incentives and corrective measures to the individuals deprived of liberty for the determined period. The paper analyses general theoretical issues connected with the process of administration of incentives and corrective measures to the individuals deprived of liberty for the determined period. The study also explores the historical origin of normative consolidation of incentives and corrective measures in Ukrainian legal system on various stages of development. The thesis considers the types of incentives and corrective measures, as well as grounds and order of their administration. A particular emphasis is placed on the importance of investigation of the offender’s personality. This investigation should be conducted during the whole period of service of sentence, taking into account the gravity of offence and adequacy of the corrective measures. Having performed a survey, it became possible to give criminal, criminological, and penal characteristics of the individuals deprived of liberty for the determined period. Special attention is given to the role of incentives and corrective measures. The research provides a number of propositions concerning changes and amendments to the articles of the Criminal Procedure Code of Ukraine that regulate the issues of administration of incentives and corrective measures to the individuals deprived of liberty for the determined period.
