Юридичні конструкції та їх використання в законотворчій практиці України: монографія

Abstract

У роботі здійснено комплексну загальнотеоретичну характеристику юридичних конструкцій як засобів законотворчої техніки та проаналізовано основні вимоги до їх використання у законотворчій практиці України, зокрема в цивільному та цивільному процесуальному законодавстві. Обґрунтовано комплексний характер використання елементів законотворчої техніки при створенні законів; виявлено конструктивно-прагматичну та нормоутворюючу функції юридичних конструкцій як засобів законотворчої техніки. На основі дослідження юридичних конструкцій як системи термінопонять, що відображає структуру правових явищ, встановлено вимоги до їх створення. Виявлено особливості юридичних конструкцій приватного і публічного права. The thesis focuses on the complex general theoretical characteristics of legal constructions as means of legislative technique and their main use requirements in the legislative practice of Ukraine. The thesis explains the complex character of legislative technique elements use in the process of laws formation; suggests author’s definition of the notion of legal constructions as means of legislative technique. The conclusion about legal constructions being the prerequisite for the use of the other elements of legislative technique is substantiated. The constructive and pragmatic as well as rule-proclaiming function of legal constructions as means of legislative technique is elicited. It is proved that legal constructions are means of forming of the very ruleproclaiming orders (regulatory, protective, defensive). On the basis of research of legal constructions as terminological system of notions reflecting the structure of legal phenomena, the demands concerning their formation are established. The paper reveals peculiarities of legal constructions in the field of private and public law.
