Адміністративно-правове регулювання діяльності правоохоронних органів у демократичній державі

Abstract

Досліджено роль правоохоронних органів демократичної держави в забезпеченні правопорядку. Правоохоронні органи розглянуто як державні органи, уповноважені на здійснення контролю за дотриманням законодавства у певній визначеній галузі права, застосування примусу для забезпечення вико- нання поставлених перед ними завдань. Розкрито зміст правоохоронних ор- ганів держави, організація і порядок діяльності яких визначаються законом. The reality of ensuring human rights and freedoms is one of the most important indices of the level of a civilized society; as a person needs to receive the effective state protection not only in law but also in practice. Most of the world countries pay a significant attention to the improvement of the organization and the activities of law enforcement agencies. Law enforcement agencies symbolize the presence of the State in our daily lives, its ability to intervene and protect when such protection is needed. They can also act as a symbol of integrity of the society and its devotion to the values of honor, duty, represent monopoly of the State on the use of force, which is a necessary condition for ensuring effective action of law, and deter the society from committing crimes, immoral actions, evil intentions, conspiracies to commit illegal actions. Law enforcement agencies are perceived by the society as an institution that has authority to operate (including to use force) here and now, and it allows you to solve a wide variety of almost all kinds of human problems and this is the feature that is common to such different acts as detention of the offender, order control, intervention in cases of domestic violence, etc. Accordingly, it is important that law enforcement agencies comply with the expectations of not only the law, but also of the society. The article deals with the role of law enforcement agencies in the democratic state in maintaining law and order. Law enforcement agencies are considered as government agencies authorized to exercise control over observance of the legislation in a specific branch of law, the use of coercion for fulfillment of tasks set before them.
