Чинники та форми деформації правосвідомості

Abstract

Розглянуто суть, структуру, функції свідомості; політичні, організаційно-управлінські, правові, морально-психологічні чинники деформації правосвідомості, її психологічні риси та основні форми: прaвовий нiгiлiзм, прaвовий фетишизм, прaвовий iдеaлiзм, прaвовий суб’єктивiзм, прaвовий релятивiзм, прaвовий дилетaнтизм, прaвовий фетишизм тощо, – які взаємопов’язані та утворюють специфічну цілісність, що має негативне забарвлення. Legal awareness is the sphere of individual consciousness that reflects the legal reality in the form of legal knowledge, evaluative attitude toward the law and its application, legal system and values that govern human behavior in legally relevant situations. Legal ideology, legal psychology, rational and ideological, emotional and psychological and behavioral guidelines elements are pointed out in the structure of legal awareness. The concept «legal awareness deformation» allows to describe its state under the influence of external and internal factors which form distorted (deviation from the norm) picture of legal activity and values, ideas, views, infusions, emotions and behavior models that may lead to negative social consequences. Political, organizational and managerial, legal, moral and psychological factors of legal awareness deformation are pointed out. It is characterized by the following psychological traits: legal, psychological dependence on the immediate and social environment; intellectual immaturity; the inability of the individual to grasp the scope of legal activity; lack of personal dignity; the inability of individuals to assert their rights, beliefs and attitudes; simplified understanding of the nature of the legal processes; underestimation of personal rights and freedoms; irrational principles of legal behavior; mainly emotional perception of the legal life; attitude to personal political rights as an obligation to society; intolerance to diversity of legal life; feeling of noninvolvement into social legal process. The basic forms of legal awareness deformation include: legal nihilism, legal fetishism, legal idealism, legal subjectivity, legal relativism, legal amateurism. These forms of deformed legal awareness constitute specific integrity that has negative connotations.
