Практичні засади усунення протидії розслідуванню злочинів у сучасних умовах

Abstract

Проаналізовано низку проблем, які реально загрожують розслідуванню кримінальних злочинів у сучасних умовах. Охарактеризовано найпоширеніші види протидії розслідуванню злочинів правоохоронними органами, які виявляються в різних видах і формах. Аргументовано необхідність подолання протидії розслідуванню злочинів. Розглянуто основні напрями боротьби з подолання протидії розслідуванню злочинів і протиправну діяльність зацікавлених осіб, яка спрямована на приховування розкриття злочинів та їх розслідування. A number of problems that create a real threat to the investigation of criminal offenses in modern conditions are analyzed. The most common types of counteraction to the investigation of crimes by law enforcement bodies that are manifested in various forms are described. The necessity to overcome the counteraction to the investigation of crimes was argued and the main directions under which the struggle for coping with the investigation of crimes and illegal activities of the interested persons can be carried out, which is aimed at concealing the crime detection and their investigation. Practice shows that under current conditions the actual problem is the struggle against counteraction of the detection and investigation of a crime by law enforcement. According to the results of the survey among the investigators of the Prosecutor’s Office and the Ministry of Internal Affairs of Ukraine, the following forms of the counteraction of the crimes investigation can be highlighted: concealment of crimes, false testimonies, falsification of evidence, destruction of criminal cases, destruction of evidences of a criminal case, threats to witnesses and victims, threats to investigator, prosecutor, judge, corruption among law enforcement officers, negative use of the media, use of physical influence on members of the Criminal Proceedings. The need to overcome obstacles of the counteraction of the crimes investigation becomes relevant and extremely necessary.
