dc.description.abstractЗдійснено порівняльний аналіз законодавчого регулювання територіальної компетенції державних нотаріальних контор Української РСР та незалежної України. Залежно від видів органів, які уповноважені на вчинення нотаріальних дій, виокремлено чотири групи територіальної компетенції. Legal issues, including the legislative regulation of the territorial competence of the notary bodies of the state, are considered. The author carries out a comparative analysis of the legislative regulation of the territorial competence of the notary public’s offices of the Ukrainian SSR and independent Ukraine. Depending on the types of bodies authorized to make notarial acts, as well as the acts that equal to notarial, the author distinguishes four groups of the territorial competence: the territorial competence of the public and private notaries; the territorial competence of public individuals and official persons authorized to make notarial acts that equal to notarial under Articles 40, 40-1, 78 of the Law of Ukraine «On Notariate»; the territorial competence of officials of local self-government bodies; the territorial competence of consular institutions of Ukraine. Special features of the observance of the norms of the territorial competence by public notaries in terms of Lviv region are characterized. Seven groups of types of notarial acts that are subject to obligatory execution by public and private notaries within the notarial district are determined. The author gives the definition of the territorial notary competence. It is proposed to add an amendment to Article 9 of the Law of Ukraine «On Notariate» regarding limitations of making notarial acts by consular institutions of Ukraine. The author proves that compliance with the rules of the territorial competence by bodies of notariate and quasi-notariate will lead to a reduction of litigation, including disputes that arise in drawing up a legacy on the basis of wills certified with violation of Article 13-1 of the Law of Ukraine «On Notariate». Надано авторське визначення поняття територіальної компетенції нотаріальних органів. Виокремлено сім груп видів нотаріальних дій, які підлягають обов’язковому вчиненню державними та приватними нотаріусами у межах нотаріального округу.
