Діяльність правоохоронних органів Республіки Польщі у сфері протидії корупції

Abstract

Досліджено правові основи функціонування спеціалізованого антикорупційного органу Республіки Польщі та його основні завдання зі здійснення діяльності у сфері попередження, протидії корупції та боротьби з нею. Проаналізовано роботу Центрального антикорупційного бюро за окремими напрямами, наведено статистичні відомості про результати службово-професійної діяльності його працівників. The article is dedicated to the research of legal grounds of functioning of Central Anti-Corruption Bureau of Republic of Poland and its main tasks concerning prevention, counteraction and fighting against corruption. Studying of the foreign experience of law enforcement authorities in the sphere of corruption counteraction must improve the native anti-corruption legislation and its harmonization with EU Law. The insistent educational work carried out by different public institutions has an influence on public attitudes to corruption in different spheres of social life. The results of public opinion roll shows that about 30% of polled people are ready to testify against corrupt officials if necessary. It is expediency to use experience in the sphere of corruption counteraction. Besides the special anti-corruption agency, the tasks concerning the detection, stopping and investigation of corrupt crimes are put on police, Internal Security Agency, public prosecutor office, Border Guard, Military gendarmerie. The activity of law enforcement authorities of Republic of Poland in the sphere of corruption counteraction in certain areas is analyzed. Particularly, the dynamic changes in number of corrupt crimes in the period of 2007-2014 years are shown. The statistical information in the period of 2012-2014 years concerning the preliminary investigation, legal grounds which cause the preliminary investigation, the legal qualification of investigated corrupt offences, the number of suspected in committing corrupt offences and the number of convicted for its commitment are made. The attention is paid on the subjects who committed the corrupt crimes, their age and sex, kinds of precautions, used by law enforcement authorities and penalties ( terms of imprisonment) which were applied to them.
