Методологія дослідження інформаційних технологій у публічному управлінні

Abstract

Розглянуто питання методології дослідження інформаційних технологій у публічному управлінні в контексті розвитку інформаційно-комунікаційних технологій і систем й інформаційного суспільства в Україні. З позиції інформаційного права та методологічних засад розвитку інформаційного суспільства проаналізовано синергетичні аспекти застосування інструментального, системного і структурного методів у дослідженні інформаційних технологій у публічному управлінні. The article deals with the issues of methodology of information technologies research in public administration of Ukraine. Taking into consideration information law, methodological bases of the development of the information society, the author examines the synergistic aspects of the application of instrumental, system and structural methods for the study of information technologies in public administration. Understanding the system structure of the legal mechanism, the development of the mechanism of legal regulation of information technologies in public administration is the irreversible changes that occur with it, in samples of behavior of the subjects of law, their legal awareness and legal relations in the process of its functioning. The result of the changes is consistent synergetics of subsystems in the interval between different moments in time, within and with the help of functioning of the legal mechanism. It gives the opportunity to identify issues requiring reinterpretation. It is necessary to carry out system researches to show the process of interaction between the subsystems of the legal mechanism that determines the occurrence of the legal regulation as a combined, integrative feature. Existing theories give the understanding of those factors and forces, environments, conditions and specific features that affect the legal regulation. Among them are human behavior, motivation, cultural traditions, economic basis, natural conditions, political opportunities, inadequacy of legislative techniques, and other subjective and objective causal complexes. Legal regulation occurs as a result of a certain correlation, the relationship between legal relations, legal consciousness and formalized law. Now there are few really compelling arguments in favor of one or another point of view. There is a reason to hope that the theory of systems will find such arguments. Study of possible options for the behavioral reactions of the mechanism of legal regulation of the use of information technologies in public administration is related to its research as a complicated synergetic system.
