Дозвіл як спосіб правового регулювання, класифікація видів дозволів у сфері телекомунікації

Abstract

Розглянуто питання правового регулювання у сфері телекомунікацій із погляду дозвільної системи у контексті європейських стандартів правового регулювання та національного права. Проаналізовано дозвільну систему в сфері телекомунікацій з позиції адміністративного права на підставі особливостей правового регулювання у телекомунікаційній сфері. Наведено різні види класифікацій дозволів, які існують у національній правовій системі, та запропоновано класифікацію дозволів, що використовуються у сфері телекомунікацій. Licensing system is one of the most important institutions of law. Having administrative and legal nature, the licensing system in the field of tele-communications is aimed at regulating relations of realization of informational rights and freedoms, limits of the permitted and unpermitted in the sphere of economic and entrepreneurial activities, and protection of foreign economic interests in Ukraine. The current administrative legislation does not give a legitimate definition of such concepts as licensing authority, administrative permission, administrative licensing system, administrative licensing activities, licensing administrative and legal regime, administrative and licensing procedures, etc. This circumstance does not contribute to the creation of the acceptable doctrine of licensing system and the detection of limits of its application. Permissions in telecommunications can be classified according to various criteria. Division of licensing procedures by groups allows you to systematize existing types of administrative licensing procedures in the field of telecommunications, dividing them in accordance with the essential features of the licensing act. Permission as a method of legal regulation in the field of telecommunication is a connecting link providing interaction and integration of all levels and elements of the system of legal regulation. Mechanisms of legal regulation in the field of telecommunications have administrative and organizational, administrative and legal, information and communication components. The feature of administrative and legal component of the mechanism of legal regulation consists in permission based on the appropriate administrative and legal regimes. Introduction of permissions as a method of legal regulation in the telecommunications sector ensures the integrity of the information sphere that is developed according to certain regularities. It is necessary to take into consideration the regularities of the development of the information sector as it increases the effectiveness of the implementation of information systems in all spheres of the society.
