Кримінологічна характеристика злочинів, учинених засудженими в установах виконання покарання

Abstract

Розглянуто поняття та зміст кримінологічної характеристики зло-чинності в установах виконання покарання. Охарактеризовано структуру і динаміку злочинів, що вчиняються засудженими у місцях позбавлення волі. Окреслено методику відслідкування злочинності в установах виконання пока-рання. Визначено основні обставини, які сприяють учиненню злочинів засудженими в установах виконання покарання залежно від виду рівня безпеки колонії. З’ясовано залежність пенітенціарної злочинності від конкретної оперативної обстановки в установі й стану загальної злочинності в Україні. The article deals with a concept and content of criminological description of crimes committed by the convicted in the establishments of punishment execution. The structure and dynamics of crimes committed by the convicted in the places of imprisonment are described. The methodology to track crimes in the establishments of punishment execution is outlined. Basic circumstances that assist committing of crimes by the convicted in the establishments of punishment execution depending on the type of the regime of their keeping are determined. For the preventive activity of subdivisions of the establishments of punishment execution of the penitentiary system of Ukraine the determination of the concept of criminality in the places of imprisonment is conditioned for its faultless results application in practice, deeper and purposeful study of criminogenic terms, that cause the outlined criminality spreading, the development of scientifically reasonable conclusions and recommendations led to the improvement of strategy and tactics of their counteraction. Criminality in the places of imprisonment is a thorny and serious problem not only for criminal-executive establishments, but also for all the society on the whole. Committing of crimes by the convicted in the process of punishment serving affirms the presence of serious defects and contradictions that arise in the process of imprisonment execution. Penitentiary criminality depends on a definite operative situation that arises in a certain reformatory and the state of general criminality in Ukraine. At the same time the majority of penitentiary crimes is presented in malicious disobedience to the legal administration requirements, the illegal drug trafficking, escapes and violence over the persons who serve the sentence.
