Юридичний аспект залучення громадян до управління в діяльності органів місцевого самоврядування

Abstract

Заналізовано проблеми реалізації форм прямої та представницької демократії, закріплених у законодавстві України, з метою забезпечення здійснення реального народовладдя. Досліджено стан правового регулювання централізованого та локального характеру референдумів, виборів, загальних зборів, місцевих ініціатив, громадських слухань, органів самоорганізації населення; наведено висновок, що сучасні форми є недосконалими та складними у застосуванні і у поєднанні із громадянською пасивністю та низьким рівнем правової культури набувають декоративного значення у системі реалізації політичних прав громадян в Україні. Констатовано, що прогалини законодавства можуть бути виправлені шляхом локальної нормотворчості завдяки прийняттю статутів територіальних громад або відповідних положень органами місцевого самоврядування. Тhe article deals with the problems of implementing the forms of direct and representative democracy, envisaged in the legislation of Ukraine, in order to ensure the real government by the people. The state of the legal regulation of the centralized and local referendums, elections, general collections, local initiatives, public hearings stipulates a conclusion, that today’s forms are imperfect and difficult in application. They in combination with civil passivity and low level of legal culture acquire a decorative significance in the system of realization of citizens’ political rights in Ukraine. Development of the institutions of providing the access of citizens to information about the activities of bodies of local self-government, including the development of the system of consultative-deliberative bodies with involving activists and representatives of public became the important achievement of recent years in this field. Research of foreign experience specifies the considerable potential of forms of involving citizens to the management in activities of bodies of local self-government. At the same time, comparing with the Ukrainian realities proves weaker positions in providing the participation of citizens in the management not only in relation to the states of the recognized democracies but also with a part of the Eastern Europe states of the former socialistic camp. Certain mechanisms and experience should be used in Ukraine. The involvement of active members of the community can help develop an effective system of governance at the local level. Accepting of charters of territorial communities or corresponding provisions by local councils can correct the gaps of the legislation. It is necessary to increase the activity and the level of public consciousness and responsibility of the community.
