Abstract: Розглянуто актуальні питання правового регулювання нотаріальної діяльності, зокрема правове регулювання діяльності праорганів нотаріату на території Візантійської імперії. Проаналізовано нормативний акт «Книги Епарха». Окреслено порядок доступу до професії табулярія як праоргану нотаріату. Зроблено висновок, що до цеху (корпорації) табуляріїв також належали викладачі законів і вчителі. Зауважено, що більшість норм «Книги Епарха» є актуальними і нині. The article deals with the topical issues of notarial activity. The problems of legal regulation of ancient notary service board on the territory of the Byzantine Empire are considered. In the Byzantine Empire, the activity of ancient notary service board was described in the Code of Justinian, Justinian Novels, and Institutions of Justinian. The author analyzes of normative act of the Book of the Prefect or Eparch –a set of charters of the Constantinopolitan guilds of the Byzantine Emperor Leo VI the Wise (886-912), which was called the Notarial code among notaries. The book of Eparch is the first known normative-legal act that regulated the activity of the tabularium – the ancient notary service board. The first chapter of the book is the college of notaries (contract lawyers). This is the longest chapter in the work and, as it can probably be associated with the reign of Leo VI, predates the other chapters. The chapter sets strict regulations for entry into the college of notaries. This paper describes the procedure for access to the profession of the college of notaries including requirements to the applicants for specified posts. The candidate for the position must be an educated, intellectual and religious person of the mature age who: has the necessary knowledge of laws, correct language and is able to express opinions in a proper way; got encyclopedic education; passed an appropriate exam. The process of occupation of the tabularium post and swearing is traced. The college of notaries had to conduct its activity within the notarial district – Chair (department). The activity of the college of notaries was carried out under the hard control of primicarium. Tabularium had also to carry out charitable activity. The author concludes that the guild of tabularium (corporation) also included the Faculty of laws and teachers. The requirements for primicarium – a head of the guild that is elected at the general meeting and approved by the diocesan are settled. It is investigated that the normative act regulates the payment of tabularium for notarial acts, including the conclusion of contracts. The author notes that the normative act contains the term «tabularium-symboleograph». The standards of the Book of Eparch is a confirmation of high significance of tabularium in the society and its corporatism.
