Цивільно-правові аспекти виконання журналістом у редакції своїх функціональних обов’язків

Abstract

Досліджено проблеми правового регулювання авторського права у журналістській діяльності, правові особливості збирання інформації, написання журналістом статті, редагування, переклад матеріалу тощо. На підставі проведеного дослідження встановлено, що журналістом є особа, яка виконує посадові обов’язки у ЗМІ, зокрема, збирає і займається підготовкою інформації, тому журналіст не завжди виступає як автор. Відтак, коли результатом виконання посадових обов’язків є написання статті, то журналіст стає суб’єктом авторського права на результат своєї праці. З’ясовано, що автор і журналіст є рівними лише внаслідок творчої праці. In this article the problems of legal regulation of copyright in the journalistic activity are researched. On the basis of conducted research it was established that journalist is a person, who performs job responsibilities in Mass Media, in particular, collects and prepares information, thus, journalist does not always acts as the author. When the result of performing job responsibilities is an article written, the journalist becomes a subject of copyright on the outcome of his/her work. Only creative work equates the author and the journalist. This research shows legal peculiarities of the following functional duties of journalist. Firstly, information collecting and processing. Secondly, writing of the article. Article is a genre of composition. It is established that composition should comply with the following criteria: be a result of creative activity; be expressed in the objective form, regardless of whether it was communicated to a wide range of people, or not; have a possibility of reproduction. Thirdly, journalist’s performing of the function of complier. Fourthly, journalist’s performing of the function of editor. It is established that two types of editing in the journalistic activity can be singled out: editing as a result of editor’s performing of his\her job responsibilities (this type of editing doesn’t entitle the editor to change the core of the work) and editing by which the editor is changing the work meaningfully (under such conditions the editor becomes a subject of copyright, in particular, a coauthor of copyright object created together with journalist). Fifthly, journalist’s performing of the function of translator.
